WORKING OF OUR CONSTITUTION: SOME EXPERIENCES

It was pleasure to be part of the Constitution day function on 26th November, 2019 at Ahmadabad, jointly organised by Gujarat High Court and the Gujarat Government. 
Here is the text of speech given on that occasion. Due to shortage of time, a part of the same was not spoken and part of it was spoken in Hindi, out of respect of the Governor, who is a Hindi lover. The Governor also has great command over Sanskrit as well as very good knowledge of Vedas and Purans.

WISH TO DEDICATE SOMETHING MORE

Sometime ago, I was invited to be part of 2nd convocation (held on 11-11-2019) of Professor Rajendra Singh (Rajju Bhaiya) State University, Allahabbad and was requested to share some memories of Rajju Bhaiya, the fourth Sar-Sanghchalak of RSS to inspire the students. 
I have spent my childhood with him have many memories. It was a very pleasant experience. Here is what I spoke. In order to be more relevant to the student, it was in Hindi.

THE POPULATION CONTROL BILL

Two areas are close to my heart, namely population control and uniform civil code. I had drafted bills in late 1990's before I was offered judgeship. The bills were distributed in the Parliament at that time but before they could be introduced (whether as a bill from the public or as a private member bill) the Parliament was dissolved. 
When the Central government has asked the Law Commission to examine the issue of implementing the Uniform Civil Code I had published the bill relating to Uniform Civil Code in respect to the areas, where beginning should be made. 
Population control perhaps is more important than Uniform Civil Code. Population explosion not only drowns the progress that we make but is also destroying our environment and jungles. Our future generations and mother earth will be deprived not only of many species but also of water. Here is the draft of bill for control of population. it should be enacted immediately.

WHEN LINCOLN DEFIED THE COURT


Sometime ago, I read a booklet 'Writ of Habeas Corpus. Exparte Merryman' by Henry Dutton. This is an article that was published in October 1861 issue of 'American Law Registered' now published as 'University of Pennsylvania Law Review'. It raised my interest in the case of John Merryman, who was detained by military authorities during American civil was but was not released despite order in his Habeas corpus petition by Justice Roger Brooke Taney, Chief Justice of US Supreme Court and contempt order. 

This is the only case when the President did not comply with the order of the court despite the fact that military commander was held in contempt. 

The case involved with the interpretation of Article 1 section 9 (2) of the US Constitution to determine, 'Whether president has power to suspend Habeas Corpus or not'. Here is the result of that interest.

TOWER OF BABEL - PRESERVE NATURE

Serendipity Arts Festival is being organised in Goa for last few years. This year it was organised from 15th to 22nd December 2018. Khoj International Artists' Association, under the direction of Zuleikha Chaudhary, staged a courtroom drama. The background was that a luxury resort was set up displacing the poor and affecting landscape as well as ecology of the area. The setting up of luxury resort was upheld by the Supreme Court and thereafter due to public outpouring, a commission was set up to consider their concerns. I was requested to play the role of the judge commissioner. 
The drama was played on 16th of December and venue was old Goa Medical College. I was given free hand to make my recommendation. One of the witnesses talked about Tower of Babel and his interpretation to it. This inspired me to have my interpretation to the myth.  Here is my decision and interpretation to the myth of the Tower of Babel.
